I am trying to find out if anyone knows of any lawsuits (small claims or higher courts) that involve an RVP suing their downline for a rollup following a resignation, but the agent not getting any credit for all the earns that also accrued during the year following termination. It seems like a "have your cake and eat it too" circumstance, as every (former) RVP I know has stated that they always viewed the earns (which are paid to the RVP) as an offset to the chargebacks. It seems that, if you perform a sale, the contract level you are at dictates the commission to be paid, but this is the fuzzy part as the contract is somewhat contradictory, plus I don't see how the earns can be legally withheld.

Also, does anyone know of any lawsuits involving falsified 1099s from PFS? I received 1099s in 2002 even though I resigned in 2001, for supposed income in life & securities. I think these were the earns that were paid to the RVP.

Any help, ideas, guidance, etc. would help.
