: : so Ann--do you tell all your clients to go straight to an attorney no matter the circumstances, to "protect their rights"?
: : Sounds as if you have watched one too many ambulance chaser commercials on late night TV.
: : Now that they have denied liablility, your options are agreeing with them, going to small claims court yourself, or going to an attorney. None of them a good thing, and none of them easy.
: : Remember they probably owe you for the loss of use of the vehicle (rental) for a reasonable period of time---include that if you go to small claims.
: : Good luck. I have to mention also, that if your insurance company were in the position of possibly paying for the tractor trailer damage, they would put more stock in what you told them as well (just like the trucking company/Progressive).

: : : : March 14th my daughter was involved in an accident with a tractor trailer insured by Progressive Insurance. Progressive sent a letter that said that its findings are inconclussive and therefore they are siding with their driver. When I called them today they said the evidence points to my daughter being at fault. They believe their insured. One thing I definately know, liars and thieves always hang together.
: : : : I told the Progressive man that I talked to that
: : : : "I hope Progressive is happy that they just stole thousands of dollars from a hard working poor family." He had the nerve to ask me if I wanted to talk to the man handling the case. I reponded with "No, his only purpose is to save the company money by stealing from people."
: : : : We will be contacting a lawyer.
: : : **************************************************
: : : Your mistake was in not contacting an attorney when the accident first happened. You may have damaged your claim by trying to handle in on your own.
: : : A good legal representative could have helped to get the maximum amount for your claim.

: Obviously, Keith she would have been better off seeking the advice of an attorney since it seems as though the insurance company is failing to do what is right by her. Small claims court what a laugh. There is a limit on what you can collect in small claims. ANYONE THAT IS INVOLVED ANY TYPE OF ACCIDENT CALL AN ATTORNEY IMMEDIATELY! Do not leave the door open for an Insurance company or some slapdash adjuster to come in and take advantage of you!
