They post references to articles on their website which refer to themselves as an MLM. The definition you provided, part (2) nearly defines a "pyramid scheme", and very few if any companies that I know of fit the (1) definition. MLM basically means you "hire" a downline who can in turn hire their own downline, with no restrictions on numbers.
