"I needed a 1031 Qualified Intermediary that could execute the moment all the approvals lined up and not make me pay for the uncertainty.”‍‍‍ — Alvin A.
"The goal is to purchase and manage this property in perpetuity, primarily for its habitat, cultural, and climate resilience values, but also for tribal resource access and passive recreation for the tribe and the public. Protection of this property—one of the last great pieces of undeveloped oceanfront in the region—is a critical, urgent priority for meeting Oregon’s coastal resilience and conservation goals" — Oregon Department of Land Conservation and Development, Coastal Management Program

When Alvin bought a wild, windswept stretch of the Oregon Coast in 1989, it was 50 acres of rugged beauty: two creeks crossing to the sea, roughly 1,200 feet of beachfront, and bluffs rising to 100 feet with panoramic views. U.S. 101 ran right through it. Parts had been logged generations ago; others remained untouched to protect the waterways.

Over time, Alvin learned more of the land’s story. The area had long been part of the Siletz people’s coastal territory; a local figure named Collins had once managed relationships with the tribe and even organized gold mining along the river outlet. That history stuck with Alvin. For decades he and two other families planned to subdivide and develop, but life, markets—and the 2008 downturn—kept the larger project on pause.

In the background, the Confederated Tribes of Siletz Indians were methodically working with federal partners to reclaim and preserve culturally and environmentally significant coastal lands. The Tribe reached out to Alvin a decade before the sale, and when a NOAA grant to protect threatened lands and species materialized, real momentum finally arrived.

It also came with complexity.

“You had NOAA, the Tribe, state DOJ—every contract change triggered multiple reviews. A single Zoom could have ten people on the other side,” Alvin said. “It took about two years to come together, and we didn’t have a predictable closing date until the last 90 days.”

‍

The 1031 Challenge: Big Gain, Uncertain Clock

By the time the deal looked real, Alvin’s numbers were stark: a sale over $4 million after decades of ownership was going to leave his family with a sizable tax bill. “It would’ve been smarter to die first and let my wife sell it,” he joked—an acknowledgment of the step-up basis rules. Instead, he wanted to defer the tax hit and redeploy, but the closing date could land with little notice.

Alvin, a lawyer for 30+ years who was handling the transaction himself, started looking for a Qualified Intermediary that could move fast without the usual friction.

“Who likes a fee to start with? The Deferred solution was very attractive to someone like me.”

He chose Deferred for its No Fee 1031 structure and modern, transparent platform that made a complex process feel manageable.

Deferred’s Role: Make a Federal–Tribal Closing Feel Routine

‍Prepare for the unpredictable. Deferred pre‑built the entire 1031 exchange package, stood up a segregated bank account held FBO in Alvin’s name, and mapped a “go‑now” closing plan with escrow and counsel so funds could deposit immediately once approvals hit.

Coordinate across agencies and counsel. Deferred worked directly with the Tribe’s team, escrow, and state DOJ counterparts on timing, document updates, and title mechanics uniquely common to sovereign buyers and grant‑funded acquisitions—without slowing the deal.

Protect the client’s economics. With no setup or cancellation fees, Alvin wasn’t penalized for delays beyond his control, and interest earned on exchange funds was credited back to him.

Keep Alvin in control. Deferred's platform gave Alvin real‑time status, secure document exchange, and clear deadlines for 45‑day identification and 180‑day closing windows. The team was reachable 7 days a week—crucial when the call could come at any time.

Preservation Achieved, 1031 Preserved

Alvin's Outcome:

  • Coastal acreage transferred to Siletz tribal stewardship for future preservation
  • Full capital gain deferred via a §1031 exchange on a sale of $4.9M
  • No Fee 1031, interest shared, and complete transparency end‑to‑end
  • Exchange executed on a compressed, unpredictable timeline
  • A clear path to sustained tax deferral and eventual step‑up for heirs

Despite a grant-driven, unpredictable timeline and layers of tribal, federal, and state review, Deferred turned a high-stakes sale into a clean close—so the coastland could return to Siletz care and its legacy endure.
